YEZ is very sensitive to your desire to keep your personal information out of the hands of those who would use such information improperly.   Indeed, we share the same concerns with respect to our own information and data as well as the information and data of our customers and business associates. To demonstrate our dedication to respecting the privacy of your information, we have developed this Privacy Policy to disclose what types of information we may collect from you and how we might use that information.   This Privacy Policy applies to The Youth Enterprise Zone, or its subsidiaries and affiliates   (collectively, “ YEZ ”, “ we ”, “ us ” or the like)

For purposes of this Privacy Policy, the term “ Website ” refers to each of the web pages contained in all the websites owned, operated or controlled by us, including any website through which we may provide any of our products or services (collectively, the “ Services ”).

As described below, some of your nonpublic personal information is disclosed to affiliated and carefully selected nonaffiliated third parties and used by us and such third parties. By accepting our Terms of Use or by using our Services, you expressly consent to our use and disclosure of your nonpublic personal information in the manner disclosed below. Please note in particular that by accepting the Terms of Service or by using our Services, you acknowledge and agree that the Pennsylvania Electronic Transactions Act (“PETA”) applies to the transactions conducted on or through the Website and that you and YEZ may conduct any transactions contemplated herein by electronic means.   This means that you expressly agree to receive communications and disclosures from YEZ, including those relating to privacy matters, via electronic mail, the Website or other electronic means.   

Because of the rapidly evolving legal and business environment surrounding privacy on the Internet, please be aware that YEZ must reserve the right to modify this Privacy Policy at any time, in which event we will provide you with reasonable notice of the changes. Please bear in mind that this Privacy Policy only addresses the use and disclosure of information we collect from you. To the extent that you disclose information or data to other parties or other websites on the Internet, including websites that you may reach through YEZ's Website, different rules or policies may apply.

What Nonpublic Personal Information of Mine Does YEZ Collect?

Information You Provide

YEZ collects information that you voluntarily submit during the registration process through interactive questionnaires, applications or other forms.   We may also offer additional tools or Services or request other information from you from time to time or through fashion chat rooms and bulletin boards we may decide to offer on the Website.   Should you wish to not reveal this kind of information, you should abstain from completing the applicable questionnaire, application or form.   Please be aware, however, that certain information is required in order for us to provide the Services.   If you elect not to share required information, you may not be able to receive such Services.

For most activities, we will need to collect only your email address, password and a minimum of five of your body measurements.   We may also ask you to provide additional optional information, such as your name, address, age, phone number, and other relevant information.

If you voluntarily send us any correspondence, such as emails or letters, we may retain and use such correspondence and information in a file specific to you.   Similarly, if you voluntarily submit postings or otherwise participate in any available chat rooms or bulletin boards on our Website, such information will become publicly available.

Information We Collect Through Technology

In order to measure the usefulness and efficiency of our Website, we automatically track certain information from all our visitors. The types of information we might track may include the Internet address that you just came from, which Internet address you go to, what browser you are using, your computer operating system and your computer's unique Internet Protocol address.   We may also collect information regarding apparel, garment and accessory purchases you may make through websites operated or controlled by third parties with whom we may have a business relationship.

How Does YEZ Use My Information?

We use your information to provide you the Services and process transactions that you request.

If you have indicated your assent during the registration process, we may use your email address, your mailing address and phone number (if you voluntarily submit such information) to contact you regarding administrative notices, new Service offerings and communications relevant to your use of our Website or products, services and special offers offered by YEZ and other third parties with whom we may have a business relationship or which we otherwise feel you may find of interest.

What Categories of Information Does YEZ Disclose and to Whom is it Disclosed?

In order for YEZ to offer you quality Services, we work with some third parties.   We may disclose to these entities nonpublic personal information about you as necessary to provide these Services to us for your benefit or directly to you.   We may also choose to disclose your information to trusted nonaffiliated third parties in the future for other purposes.

Co-Brand Service Providers . YEZ may offer a number of co-branded services and products with nonaffiliated third parties, such as apparel, garment and accessory designers, manufacturers, distributors and retailers.   If you are eligible to use these types of services, we may provide your nonpublic personal information to the co-brand provider offering such services or products in order to permit you to obtain or use the applicable products or services. Because we do not control the privacy practices of these third parties, you should evaluate their practices before deciding to obtain or use the co-branded products or services offered.   In addition, a co-brand provider may directly ask you for certain information to assist it in providing you with products or services.

Companies Offering Promotions, Products or Services .   On occasion, we may decide to offer promotions – like product giveaways – in conjunction with a sponsor.   We will share your information with the sponsors if they need it to send you a product, such as a magazine subscription.   We may share your information with those sponsors so that they can send you other special promotions they offer, but only if you give us your permission to do so.   In addition, YEZ occasionally sends email promotions out to our Customers on behalf of third-party sponsors.   In this instance, we don't share your name with the third party – we do the mailing for them.   Again, we only send these promotions to you if you've given your permission.

Suppliers and Service Providers . We may use some nonaffiliated third party suppliers and service providers to directly or indirectly provide Services to our customers, and we may need to share your nonpublic personal information with them in order to permit them to provide the products and services. In some instances, the third party supplier or service provider may collect information directly from you. You should note, however, that you may not be able to obtain a particular product or service without us or you providing the information requested.

We may disclose nonpublic personal information we collect, as aggregated or otherwise, to nonaffiliated third parties who perform marketing services on our behalf or to other entities with whom we may have joint marketing arrangements in order to make a variety of products or services available to you.   We do collect nonpublic personal information as described above and may in the future disclose such nonpublic personal information to nonaffiliated third party advertisers.

Purchase or Sale of Business .   Online business is still in a very early stage and is changing and evolving rapidly.   As YEZ continually looks for ways to improve our business, we may buy or sell a company.   If we buy or sell a business, the information and data collected will likely be transferred as a part of the sale.   Information about users will be used in the aggregate.   However, if we buy a business, we will use best efforts to honor the requests that customers made of that business regarding their nonpublic personal information.   In the event that we sell a business, we will do everything reasonably within our power to ensure that the nonpublic personal information requests you made of us are honored.

How Can I Review and Change My Personally Identifiable Information?

We will retain in our files information you have requested to remove in some circumstances, for purposes such as to resolve disputes, troubleshoot problems and enforce our Terms of Service. Further, such prior information is never completely removed from our databases due to technical constraints and certain recordkeeping requirements or practices and the fact that we back up our systems. Therefore, you should not expect that all of your personally identifiable information will be completely removed from our databases in response to your requests, although we will honor your requests to change your information or our permitted email communications as soon as practically possible.

What Choices do I have About YEZ Collecting, Using, and Sharing My Information?

When you do register with us or give us personally identifiable information, you will have an opportunity – at the time we collect your information – to limit email communications from YEZ and from third parties with whom we may have a business relationship .   You can request at any time that YEZ or such third parties not send future email to you either by unsubscribing from the communication or by contacting us at bgcwpa@cs.com.   Also, as mentioned above, there are ways to limit the information collected through technology – though some of our features won't work if you decide to do this.

What Kinds of Security Procedures Does YEZ Keep In Place?

YEZ wants to ensure the security of your personal and financial information   while shopping on our web site. Please be aware that no data transmission over the Internet can be guaranteed   as 100% secure, but for this reason we employ strong security measures to protect your personal information   to the greatest extent possible. Every page of the Check Out process on the Davis & Davis web site uses SSL   (Secure Sockets Layer) to transmit your personal information to our servers. SSL is a set of rules followed by computers connected to the Internet. These rules include encryption, which guards against eavesdropping; data integrity,   which assures that your communications aren't tampered with during transmission; and authentication, which verifies   that the party actually receiving your communication is who it claims to be. Information Sharing Within YEZ.

In order to provide you with a consistent level of quality services and products, and as described above, we may share any of the nonpublic personal information that we collect about you among companies within YEZ identified above.

Under the law, we are permitted to internally share certain nonpublic personal information about you when it relates to identification and the transactions and experiences we have with you.   However, you do have the right to limit our sharing of your other nonpublic personal information within YEZ. This "other” information includes information that is used, expected to be used, or collected for the purpose of processing your orders and is not related solely to your identification or other transactions or other experiences with us.

If you choose to opt out of the sharing of this information within YEZ, we will not share non-identification, non-transaction or non-experience information about you for any accounts that you may have with us (although we may continue to share identification, transaction and experience information and other information as permitted under law). For any accounts with us that you hold jointly with another person, each person may separately opt out and joint account holders may opt out for each other. If only one joint account holder opts out, we may share information about the other joint account holders. Choosing to opt out of this information sharing may limit opportunities for you to receive product and service information that may interest you.
